Extending H1-B Status at IUPUI

If an employee is already in H-1B status at IUPUI, complete The "IUPUI H-1B Employee E-Form" through the iStart system with job description, job requirements, and comparative salary information and require the employee to complete and submit H-1B Application Information E-Form. The processing time begins when OIA receives "IUPUI Departmental H-1B Compliance Certification" from the Department Chair or Division Chief. For H1B extensions, the following documents must be provided to OIA to complete the extension petition:

  1. Check payable to DHS in the amount of $325 USD.

    Two $325 USD checks are required for a dual petition for a clinical faculty member working at IU and the departmental practice group.
  2. Employment letter addressed to the US Citizenship and Immigration Services describing:
    • the employee's current job title
    • duties
    • hours of work
    • salary
    • an indication of whether any terms and conditions of the original petition have changed. Please include a sentence: "There have been no changes in the duties or responsibilities since the last H1-B petition" if applicable.
    • new dates of employment requested (three-year maximum).

    This can be uploaded in iStart system while completing the electronic H-1B request E-Form.
  3. Updated curriculum vitae (upload in iStart).
  4. Indiana State License if a license is required for the profession in the State of Indiana (upload in iStart).
  5. Copies of I-94s (front and back) of employee (upload in iStart).
  6. Copy of passport including biographical information and expiration date (upload in iStart).
  7. Copies of all previous H-1B approval notices (Form I-797)(upload in iStart).

Additional Extension Information

  • H1-B status can be extended up to a total of six years. However, because of the Labor Condition Application (LCA) requirements, requests for extension are processed in periods of not more than three years.
  • Employees with employment-based permanent resident petitions filed by the end of the 5th year of H1-B status may continue to extend their H status beyond six years.
  • An H-1B employee can continue employment at IUPUI even after the expiration of the prior H-1B approval, provided that OIA has verified that the extension request for the same employment has been received by the USCIS. However, travel outside the US without a valid H-1B Approval Notice is not possible; therefore, we recommend that extensions be initiated at least four months before the current H-1B status expires.
